On Monday, a federal judge in Nevada, appointed by former President Barack Obama, dismissed yet another lawsuit aiming to exclude Donald Trump from the ballot in that state, as being bogus.

Trump, by far the leading candidate for the 2024 Republican presidential nomination, faces legal challenges in multiple states seeking to bar him from the ballot, with two states having already excluded him from primary consideration. Yet, both of those states have decided to abide by the law and leave Trump on the ballots pending a final decision on the matter by the US Supreme Court which is currently scheduled to be delivered in February.

The lawsuits assert that Trump is ineligible under Section 3 of the 14th Amendment, which prohibits officials who have sworn an oath to the U.S. Constitution from holding office if they engage in insurrection, even though neither the former President nor any other person has yet to be charged in any court as an insurrectionist.

Last Thursday, Maine’s Secretary of State decided to take it upon her own authority to remove Trump from that state’s 2024 ballot, preventing his participation in the March primary. That decision has also been stayed pending February’s SCOTUS decision.

Earlier this month, the Colorado Supreme Court ruled along party lines in a 4-3 vote against Trump's inclusion on the state's ballot due to his alleged role in the January 6, 2021, Capitol riot. Trump, facing federal charges related to the riot, maintains his innocence, accusing those filing lawsuits of election interference. The Colorado Republican Party has also appealed that decision to the U.S. Supreme Court though their Secretary of State has also made the decision to bypass that decision and leave the former President on the ballot in Colorado, also pending the upcoming SCOTUS decision. In an interesting move, Colorado Secretary of State Griswold also promptly certified the ballot after making that decision, guaranteeing that Trump will be on the Colorado primary ballots throughout that state’s GOP primaries.

Most recently, U.S. District Judge Gloria M. Navarro dismissed a lawsuit filed by John Anthony Castro, a presidential candidate from Texas, seeking Trump's removal from the Nevada ballot. Navarro ruled that Castro lacked standing as he manufactured the conditions leading to the lawsuit, citing his bid for the presidency.

As part of her decision, Judge Navarro stated that she found evidence that Castro is only running for office for the express purpose of filing these lawsuits all over the country and, as such, has tried to artificially manufacture legal standing. Here is part of her decision:

"In rejecting his political competitor's standing argument, courts have found that Castro improperly manufactured his standing merely to file this lawsuit."

Judge Navarro was referring to an Associated Press interview from last year when Castro admitted he was running for office for the sole purpose of filing these federal lawsuits.

"I'm not going to lie and pretend my candidacy is anything more than trying to enforce the United States Constitution, and that's what I'm here to do," Castro said.

In a publicly released statement on Tuesday, Steven Cheung, a Trump campaign spokesman, praised the Nevada court's decision as a victory for the former president. Cheung criticized similar cases seeking to bar Trump from the ballot under the 14th Amendment, agreeing with Judge Navarro and characterizing them as:

"...blatant attempts to steal the election for Crooked Joe Biden."

Cheung went on to emphasize Trump's undefeated record in federal court against such challenges and vowed to fight against all such future attacks against American democracy.
