Report: Prominent attorney Alan Dershowitz, who also was one of the impeachment lawyers on behalf of Donald Trump, said on Sunday the former President can still run in 2024 and also win and serve as President even if locked up. He still would be able to run the country "from prison", if convicted.
On Truth Social post on Saturday morning, Mr. Trump said he believed he'd be arrested Tuesday, over an investigation by District Attorney Alvin Bragg in New York. The DA has been investigating an alleged 2016 plan to pay adult star Stormy Daniels $130,000 in hush money, about an affair with Trump.
Recent actions by the City of New York and the DA's office, has led many republican and democratic legal experts to assume a history-making indictment against the former President is coming soon. Trump continues to deny the affair happened, and has strongly ripped the investigation he says is biased, a setup, and a witch hunt.
On his Sunday interview with conservative news channel Newsmax, Dershowitz said he thinks Trump will be indicted and also convicted in New York. He says he views the city's legal system as unfair,
He will be indicted," Dershowitz said. "In New York, you can indict a ham sandwich. In New York City, you can convict a ham sandwich because the jury pool is so unfair. Even if he's convicted, he can run for president. He can run for president from prison; he can even serve as president from prison."
The U.S. Constitution does allow for convicted felons to run for and hold political office, and that includes the Presidency. Many liberals and anti-Trump conservatives have pointed to the 14th Amendment, which can bar individuals who have participated in an insurrection against America, from being in office.
Some of these groups are publicly hoping the D.C. investigation of Trump regarding the raid on the Capitol, will be the thing that gets Trump barred. Other analysts say he has a good chance to beat that case as well.
