Title 42 is a COVID-era order that was initiated under former President Donald Trump. In December the order was expected to be removed but the U.S. Supreme Court ruled to keep it in place and planned to decide on its future in two months.
Since then, President Joe Biden visited the southern border and got a close-up of the migrant situation in El Paso, Texas.
After announcing his immigration plan to reduce the number of migrants legally allowed to enter the country, U.S. Customs and Border patrol stated the number of migrants crossing is still high but has lowered from the previous month in December. The numbers were down about 100,000 from the 256,000 that were recorded in the last month of the year.
This was also the first time in 10 months that encounters were below 200,000 according to Fox News.
The U.S. Supreme Court on February 16 believes Biden’s policy is working they decided to remove Title 42 from its agenda.
The Biden administration already announced Title 42 was due to expire on May 11. So for the Supreme Court to remove this from their calendar may make sense.
The Justice Department wrote:
“Absent other relevant developments, the end of the public health emergency will (among other consequences) terminate the Title 42 orders and moot this case.”
“The government has also recently announced its intent to adopt new Title 8 policies to address the situation at the border once the Title 42 orders end.”
Title 42 has allowed the United States to send 2.6 million migrants back to their home country or Mexico without requesting asylum.
