(NEW YORK) Disgraced movie producer and convicted rapist Harvey Weinstein will be extradited to California, where he will face trial for criminal sexual assault charges, according to NBC News

Weinstein, who was convicted in February 2020 in New York of third-degree rape and sentenced to 23 years in prison, faces new charges in Los Angeles based on separate sexual assault allegations from two women.

The alleged incidents happened just a day apart in February 2013.

"Just now, Mr. Weinstein’s attorney filed a writ of Habeas Corpus in the LA County Superior Court," a spokesperson for the former movie mogul said in a statement. "We are asking the court to hold off the extradition of Mr. Weinstein to Los Angeles until he can receive his needed medical care here in New York."

That writ of Habas Corpus argued Weinstein's rights could be violated by the extradition to another state because he suffers from a degenerative eye condition, requiring months of medical attention.

Gloria Allred, an attorney for the two women in the L.A. trial, said she was "very glad" about the ruling.

"I am looking forward to seeing Mr. Weinstein finally appear in Los Angeles to be arraigned on the many charges against him," Allred said.
