Suspect in Cash Gernon’s murder could face death penalty after capital murder charge in Dallas

Darriynn Brown, the 18-year-old suspect in Cash Gernon’s killing, has been charged with capital murder after the tragic Dallas death. He could face the death penalty, according to the Dallas Morning News.

The 4-year-old little boy was found dead in the middle of a road in May. He had been stabbed a few hours after being kidnapped from the bed he shared with his twin brother.

The kidnapping was caught on video footage and, despite similarities between Brown and the suspect in the video, Brown has repeated that he is not the person on camera.

Until now Brown was charged with kidnapping and theft, after he reportedly tried to kidnap a 2-year-old little girl in February.

Darriynn Brown is currently facing life sentence in prison as the minimum sentence and could even receive the death penalty if he is found guilty on the capital murder charge.

Why did the new charge come?

A spokesperson from the Dallas Police Department revealed that new evidence came to light, linking Brown to the child’s death at the time of the murder.

“Evidence submitted to the lab has been returned linking Darriynn Brown to Cash Gernon at the time of his death. Therefore, he is also being charged with Capital Murder,” was the statement for news outlets.

On Wednesday Brown’s attorney Heath Harris said that he was still trying to obtain access to evidence so he could make a case for his client.

“It's almost a month after this tragedy and I'm still waiting to prepare this kid's defense. We can't do that till we have all the evidence. This is not an open and shut case.

Even if you believe that's Brown on the video, it doesn't mean he killed the kid. The world is basically prejudicing this whole community by saying, 'That's him,'” Harris said, according to The Blaze.
“There is no doubt who took Cash, and as soon as I get the lab report back, there will be no doubt who killed him,” Lt. Carrie Wise said in May.

Brown’s bail has been set at $1.625 million. The suspect remains in the Dallas County Jail.
