43 Arrested During Memorial Day No Refusal Operations

CONROE, TX – Montgomery County Law Enforcement made 43 DWI-related arrests over the Memorial Day weekend, alongside 2 boating while intoxicated offenses during No Refusal operations.

The Precinct 4 Constable’s Office made the most DWI arrests this weekend with 10. Another 9 arrests were made by the Montgomery County Sheriff’s Office and 7 more by Conroe PD.

A total of 37 of the DWI arrests made were from first-time offenders, with 4 arrests made for second-time DWI. Only one arrest was made for a 3rd or more DWI offender, and one arrest for DWI with a child passenger.

The No Refusal operations also extend to Lake Conroe, where two arrests were made for Boating While Intoxicated.

A total of 12 blood warrants had to be issued during the No Refusal period. Blood warrants are used in instances where suspects refuse to take a breath or blood test for intoxication. An officer can call a prosecutor to draft a warrant for a sample of the suspect’s blood, which is then sent to an on-call judge to review for probable cause. If the judge approves the warrant, a nurse will take a blood sample to verify intoxication. These No Refusal Operations ensure that scientific evidence is obtained in all DWI and BWI cases and provides the prosecution with strong evidence of guilt or innocence.

No Refusal Operations are commonly held around holidays, when drinking and driving is more likely to occur. These allow for law enforcement to aggressively get drunk drivers and boaters off of roads and waterways to ensure the safety of other drivers and boaters.
